TERMS OF PURCHASE

These Terms of Purchase (“Purchase Terms”) apply to all purchases of products or services made through pvbat.com or directly from PVBAT LLC (“PVBAT,” “we,” “us,” or “our”). By placing an order, you agree to these Purchase Terms, our Terms of Service, Privacy Policy, Shipping Policy, Return Policy, and any applicable product-specific warranty terms.

1. Order Acceptance

Your submission of an order does not mean that we have accepted the order. We may accept, decline, cancel, or limit any order for reasons including, but not limited to, product availability, pricing or product description errors, suspected fraud, payment issues, shipping restrictions, or compliance concerns.

If we cancel an order after payment has been processed, we will issue a refund for the cancelled portion of the order using the original payment method, unless otherwise required by law.

2. Product Availability, Pricing, and Errors

Product descriptions, specifications, prices, promotions, and availability may change without notice. We make reasonable efforts to display accurate product information, but errors may occur. We reserve the right to correct errors, inaccuracies, or omissions and to cancel or refuse orders affected by such errors, including after an order has been submitted.

3. Payment

You agree to provide current, complete, and accurate billing and payment information. Payments are processed by third-party payment processors. PVBAT does not store full credit card numbers on its servers. Your payment may be subject to the terms and privacy policies of the applicable payment provider.

4. Taxes, Duties, and Fees

Prices listed on the website may not include sales tax, use tax, import duties, customs fees, brokerage fees, or other government charges unless expressly stated. You are responsible for taxes, duties, and fees associated with your order, except where PVBAT is legally required to collect and remit such amounts.

5. Shipping and Delivery

Shipping and delivery are governed by our [Shipping Policy]. Delivery dates are estimates and are not guaranteed unless expressly stated in writing. If we cannot ship within the promised timeframe, we will notify you and provide options as required by applicable law.

6. Address Accuracy

You are responsible for providing a complete and accurate shipping address. Please review your shipping information carefully before submitting your order. If you notice an error, contact us immediately at service@pvbat.com. We cannot guarantee that address changes can be made after an order has entered processing or shipment.

7. Installation and Product Suitability

Energy storage products, batteries, inverters, solar components, and related accessories may require proper installation, configuration, and use. You are responsible for confirming that the products you purchase are suitable for your intended use and comply with applicable electrical codes, building codes, safety requirements, utility requirements, and local laws.

Unless expressly stated in writing, PVBAT does not provide installation services. Installation, wiring, commissioning, inspection, and maintenance should be performed by qualified professionals where required by applicable law, product documentation, or safety standards.

8. Lithium Battery Safety and Shipping Restrictions

Lithium batteries and energy storage products may be subject to special handling, packaging, transportation, and return-shipping requirements. You agree not to ship or return damaged, swollen, leaking, modified, burned, punctured, or otherwise unsafe batteries unless PVBAT has provided specific written instructions.

9. Cancellations

You may request cancellation before an order has shipped or entered final fulfillment. We will make reasonable efforts to accommodate cancellation requests, but cancellation is not guaranteed once processing has begun. Orders that have shipped are subject to our Return Policy.

10. Returns and Warranty

Returns, refunds, exchanges, inspections, and warranty claims are governed by our Return Policy and applicable written warranty terms. A return authorization is required before sending any product back to PVBAT. Products returned without authorization may be refused or delayed.

11. Refused or Undeliverable Shipments

If an order is refused, undeliverable, returned due to an incorrect address, or returned due to unpaid duties or fees, you may be responsible for return shipping costs, carrier fees, storage fees, and any non-refundable charges, to the extent permitted by applicable law.

12. Resale and Unauthorized Distribution

Unless expressly authorized in writing, products purchased from PVBAT are for personal or internal business use and may not be purchased for unauthorized resale, export, or distribution. We may limit or cancel orders that appear to be placed by unauthorized resellers, brokers, or distributors.

13. Limitation of Liability

To the fullest extent permitted by applicable law, PVBAT shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the purchase, installation, use, misuse, delay, or inability to use any product. Nothing in these Purchase Terms limits rights that cannot be limited under applicable law.

14. Governing Law

These Purchase Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, unless applicable consumer protection law requires otherwise.
